Equal Employment Opportunity Commission (EEOC) Issues Update Addressing COVID-19 Antibody Testing

On June 17th, the EEOC posted updated and expanded technical assistance relating to the COVID-19 pandemic. They indicated that employers may NOT require antibody testing before allowing employees to re-enter the workplace. This is contrasted with their guidance that indicates that COVID-19 viral tests may be used in certain circumstances.
